UNCLE GARY'S MURDER
Gary Newman - 49, Grandfather, Father, Brother, Uncle and Friend
was brutally murdered on June 29th, 2001. A senseless stupid act
carried out while Gary was driving a taxi cab as a favor for a
friend.
Uncle Gary was Tim's favorite Uncle and close friend and
confidant. Tim lived with Gary on and off for many years when he
resided out on the 5th near Angus and also down at Little Lake
in Barrie. They were like brothers. Gary left 4 children behind
who are all completely devastated as you can imagine.
In August 2003 a young man loser by the name
Kelley Thackeray was arrested for this senseless crime. This
dickhead will be eligible for parole when he's 37 years old by
serving 11 years for murdering someone in cold blood. That's our
bleeding heart justice system for you, where the guilty party is
treated like a victim and the real victims are scarred and
suffer for the rest of their lives.
Below is the media report released by the South Simcoe Police
Service who did an amazing job on this case. Special thanks to
Detectives John Small and John Chalmers who dealt directly with
most of our family.
Case# 2001-07661 - Murder -
"Cabbie Killer Sentenced"
MEDIA RELEASE - South Simcoe Police Service
Date: Nov 17, 2004
Kelley Robert THACKERAY, age 26, was sentenced today to a
sentence of Life in Prison with no eligibility for parole for at
least eleven (11) years. THACKERAY had plead guilty to the
Second Degree Murder of Gary Arthur Newman on October 22nd,
2004.
Newman, a Barrie Taxi Cab driver and father of four (4) children
was working on the evening of June 28th, 2001 when he was
dispatched to Innisfil Beach Road and Highway 400 to pick up a
fare named "Chris" just before midnight. Shortly after midnight,
Newman, near death was found on Huronia Road near National Pines
Golf Course in the Town of Innisfil. Newman had been stabbed
multiple times and was pronounced dead on arrival at Royal
Victoria Hospital in Barrie. At about the same time Mr. Newman
was found by citizens travelling on Huronia Road, his Barrie
Taxi #211 was found, eight (8) kilometers away, by another
citizen in the Innisfil Industrial Park south of Innisfil Beach
Road at Highway 400.
The murder of Mr. Newman resulted in the largest and most
expensive Criminal Investigation ever undertaken by the South
Simcoe Police. Assistance was received by South Simcoe
investigators from several agencies including York Regional
Police, Barrie Police, Ontario Provincial Police, Toronto Police
and the Los Angeles County Sherriff's Department. From the onset
of the investigation police had forensic evidence that could be
linked to the killer of Mr. Newman. A bloody fingerprint found
on the steering wheel of the cab and a DNA profile were the most
valuable pieces of evidence held by police. For over two (2)
years, none of the evidence could be linked to the responsible
person. During the course of the investigation police received
276 tips from the public and interviewed several hundred persons
in an attempt to find the killer.
In early July 2003 the 273rd tip, from a member of the public,
to come into police identified Kelley THACKERAY as the possible
killer. The tipster to police had information that only the
killer or someone that had been spoken to by the killer would
know. Over a six (6) week period investigators acted on this tip
and developed enough circumstantial evidence to form the
Reasonable Grounds to arrest Mr. THACKERAY for the murder of Mr.
NEWMAN. THACKERAY confessed to the murder following his arrest.
A comparison of Mr. THACKERAY's fingerprints and DNA obtained
following his arrest were matched to the crime scene forensic
evidence and conclusively linked him to this brutal crime. Prior
to his arrest Mr. THACKERAY had no criminal convictions
resulting in his fingerprints and DNA not being on file for
comparison.
Mr. THACKERAY waived his preliminary hearing after two (2) days
and plead guilty at his first opportunity at the Superior Court
of Justice before Madame Justice M. Fuerst on October 22nd,
2004. Madame Justice Fuerst, in handing down her sentence of
Life with no parole for eleven (11) years, commented on the
brutal crime THACKERAY had committed and the devistation to the
Newman family. In considering the minimum parole eligibility
period she took into account aggravating factors of a "planned
robbery", the injuries inflicted upon the "unarmed" Mr. Newman
from behind, and an attack on a "vulnerable" sector of society
being cab drivers who work alone late at night. She also took
into account mitigating factors in Thackeray's favour of an
early guilty plea including his cooperation with police
following his arrest.
